Accreditation criteria discussed

The country's wellness industry needs an accreditation to protect the interest of customers and instill confidence in the industry and professionals, a forum organised by Federation of Indian Chambers of Commerce and Industry (FICCI) stated here today.
The ''Accreditation Programme for Wellness Centres'' held in association with Quality Council of India was attended by leading professionals in the industry. The meeting discussed the technicalities of the accreditation criteria made by the National Accreditation Board of Hospital & Healthcare (NABH).
''The difference between accreditation institutes and institutes like the ISO is that we are industry specific while ISO gives out generic certification,'' NABH assistant director Bhavna Gulati said.
The NABH accreditation criteria include legal ethical issues including rights to privacy, treatment of patients without prejudice, awareness among staff and corrective measures against violations.
NABH programme principal assessor Dr Harish Nadkari said, 'Accreditation should not be so difficult as to allow only one entity to get in, nor should it be so loose as to let anyone to come and get it.''

Mr K K Modi, Past President, FICCI, in his address, pointed out that the FICCI Healthcare Excellence Awards, were the first of its kind to recognize and honor the good and proactive work carried out by State Governments and the healthcare providers to improve healthcare services for masses by overcoming the numerous challenges faced by the Indian healthcare industry.

He said that the awards were to felicitate and commemorate those who have increased the efficiency and improved performance of healthcare sector. “With this motive we approached Quality Council of India, our support Partners and Ernst & Young Pvt Ltd, the official Tabulators. Together, with a core group of advisors, the entire process was designed and operationalised over a period of 6-8 months. The Award categories and their parameters were decided after much deliberation and brain storming amongst the Core group members.”

The awards were open to all for profit and non-profit public, private, and government organizations and subunits – including Indian subunits of foreign organizations located in India, as well as Indian healthcare organizations located overseas with certain basic criterion. The award categories include State Government with Excellence in Reforms, Excellence in Community Driven Healthcare Programme, Excellence in H R Practices, Excellence in Patient Care and last but not the least Excellence in Healthcare Delivery.

The Award process included four-stage filtering mechanism, namely, scrutinizing the information provided by Hospitals & States by the official tabulator at first stage; short listing the hospitals based on the facts and figures provided by the participants by the Interim Jury; at the final level decision of winner based on the data provided in the questionnaire, support documents justifying the numbers and presentations given by shortlisted organizations and States on their initiatives by the distinguished Jury; and simultaneous validation of documents was carried out by QCI.

The distinguished Jury for the awards included chairperson of the Jury, Justice R.C. 'Clinical research is next big thing in developing India’

BANGALORE: By 2020, India will be among the top five countries for clinical research. At a media workshop on clinical research on Thursday, Indian

society for Clinical Research (ISCR) member Arun Bhatt said it is one of the fastest growing sectors.

“Currently, India ranks 14 in the clinical research market, but will soon be among the top. It’s the next big thing in India. Other leading Asian countries are China and Korea,” he said. According to ISCR, the economic slowdown affected the industry in the initial four months. “The industry has picked up over the past nine months,” he added.
However, India’s contribution to global clinical research is only two-and-a-half-per cent.

On an average, drug development takes 15 years and the cost of any drug development cost $800 million; 60% is spent on research and development.

ISCR members said rules and guidelines for conducting clinical research in India are more stringent than any other country. “But they are not implemented effectively,” Bhatt said.

Pharma industry urges govt to withdraw WHO study on 'data exclusivity'

The domestic pharmaceutical industry has urged the government to withdraw a study launched by the World Health Organization (WHO) in consultation with the Union ministry of health on implementing 'Data Exclusivity' in India.

The industry has sought the intervention of the Department of Pharmaceuticals (DoP) to take up the issue with the health ministry so as to immediately withdraw the study on the ‘impact of Satwant Reddy Committee Recommendations on the Indian pharmaceutical industry' . This, the industry feels, is an attempt on the part of the multinational companies (MNCs) to get monopoly by creating a new IP Right.

The industry's suspicion grew all the more over the fact that a lawyer firmAnand and Anand, whose representative Pravin Anand was a member of the Satwant Reddy Committee and has in different forums expressed his views on Article 39.3 that it obligates India to implement data exclusivity, have been commissioned to prepare the study.“It is also general knowledge that the lawyers' firmAnand and Anand is a firm overwhelmingly patronised by multinational companies/clients. It only means that the ultimate aim of the study is to justify Data Exclusivity as a new IP Right”, the industry expressed its anguish to the government.

The industry is appalled by a questionnaire sent to it as part of the study as it suggests that incremental modifications, modifications in old Ayurvedic formulae, traditional knowledge, new uses of old products, combinations of already patented or out of patented drugs, etc should be allowed protection under Data Exclusivity. Industry contends that all these are non-patentable under the Patents Act which was passed by Parliament after considerable consideration.

Contending that India is not under TRIPS obligation to give data exclusivity, the industry points that the Brussels Ministerial of GATT which saw the most exhaustive debates on the subject, the Dunkle Report and the Marakkash Conference, had specifically rejected the United States' demand for a five year exclusivity under Art 39 (3) of TRIPS and they allowed only DataProtection.

To further drive home its point in this regard, the industry puts forth India's official submission to TRIPS Council on 29 June, 2001 (IP/C/W/296) “Art 39.3 of the TRIPS Agreement leaves considerable room for Member countries to implement the obligation to protect test data against unfair competition practices.The Agreement provides that 'undisclosed information' is regulated under the discipline of unfair competition, as contained in Article 10 bis of the Paris Convention.With this provision, the Agreement clearly avoids the treatment of undisclosed information as a 'property' and does not require granting 'exclusive' rights to the owner of the data”.
